Business Terms of Service

These Business Terms of Service ("Business Terms") govern commercial relationships between DevOpsil ("we", "us", "our") and any business, organization, or individual entering into an advertising, sponsorship, vendor listing, or partnership arrangement ("Partner", "you"). By engaging in any commercial arrangement with DevOpsil, you agree to these terms.
These Business Terms are supplemental to our general Terms of Service and Privacy Policy, which also apply.
1. Advertising and Sponsorships
1.1 Ad Placement
We offer various advertising formats including banner ads, sidebar ads, newsletter sponsorships, and sponsored content placements as described on our Advertise page. Placement locations, dimensions, and pricing are subject to availability and may change with reasonable notice.
1.2 Ad Content Requirements
All advertising content must:
- Be relevant to DevOps, software engineering, cloud infrastructure, or related technical audiences
- Not contain misleading claims, malware, or deceptive redirects
- Comply with applicable advertising laws and regulations
- Be clearly identifiable as advertising or sponsored content
We reserve the right to reject or remove any ad that does not meet these standards, without refund if the content was previously approved and later found to be in violation.
1.3 Editorial Independence
Sponsored content and advertising do not influence our editorial opinions, reviews, or recommendations. All sponsored content will be clearly labeled. We maintain full editorial control over all content published on DevOpsil, including sponsored reviews.
2. Vendor Listings and Reviews
2.1 Tool Directory
Free tool listings in our directory are provided at our discretion. We may edit listing descriptions for accuracy and consistency. Inclusion in the directory does not constitute an endorsement.
2.2 Sponsored Reviews
Sponsored reviews are honest assessments of your product written by our team. Payment guarantees a review will be published — it does not guarantee a favorable review. We will share a draft for factual accuracy review before publication, but final editorial decisions remain ours.
2.3 Comparison Pages
Vendor-sponsored comparison pages will be clearly marked as sponsored. We strive for factual accuracy in all comparisons. Vendors may request corrections to factual errors but may not dictate the outcome or framing of comparisons.
3. Payment Terms
3.1 Pricing
All prices are in USD unless otherwise stated. Pricing for advertising and vendor services is as listed on our Advertise and Vendors pages at the time of agreement.
3.2 Payment
Payment is due upon agreement unless otherwise negotiated in writing. For recurring placements (e.g., monthly sponsorships), payment is due at the beginning of each billing period. Late payments may result in suspension of services.
3.3 Refunds
Refunds are handled on a case-by-case basis. If we fail to deliver agreed-upon services, you are entitled to a full or partial refund. If your ad or content is removed due to a violation of these terms, no refund will be issued.
4. Intellectual Property
4.1 Your Content
You retain ownership of logos, trademarks, and ad creatives you provide. By submitting them, you grant us a non-exclusive license to display them on DevOpsil for the duration of the arrangement.
4.2 Our Content
Content created by DevOpsil (including sponsored reviews, comparison pages, and tool profiles) is owned by us. You may link to and quote from this content with attribution. You may not reproduce it in full without written permission.
5. Representations and Warranties
By entering into a commercial arrangement, you represent that:
- You have the authority to enter into this agreement on behalf of your organization
- All content and materials you provide are accurate and do not infringe on third-party rights
- Your products and services comply with applicable laws and regulations
- You will not use DevOpsil to distribute malware, engage in fraud, or mislead our audience
6. Limitation of Liability
DevOpsil provides advertising and listing services on an "as is" basis. We do not guarantee specific traffic, click-through rates, conversions, or business outcomes. Our total liability for any claim arising from a commercial arrangement shall not exceed the amount paid by you for that specific arrangement.
7. Indemnification
You agree to indemnify and hold DevOpsil harmless from any claims, damages, or expenses (including legal fees) arising from your ad content, products, services, or any breach of these Business Terms.
8. Term and Termination
Either party may terminate a commercial arrangement with 30 days written notice, unless a different term was agreed in writing. We may terminate immediately if you breach these terms. Upon termination, any prepaid amounts for undelivered services will be refunded on a pro-rata basis, unless termination was due to your breach.
9. Confidentiality
Both parties agree to keep confidential any non-public business information shared during the arrangement, including pricing, analytics, and internal strategies. This obligation survives termination.
10. Modifications
We may update these Business Terms from time to time. Active Partners will be notified of material changes via email. Continued use of our services after changes constitutes acceptance of the revised terms.
11. Governing Law
These Business Terms are governed by applicable law. Any disputes will be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
